The juridske assessment of the case complex in Homes Gulf affair was conducted in order of alderman, after verification sample processing and municipal audit note on the matter in September last year.
The law firm Kluge concludes that it was done wrong in 2005 when the plan for Southern Hankø adopted a ban on sectioning.
Planning and building Act does not provide authority to adopt a general ban sectioning so it is done. The municipal council adopted at the time the ban to hedge against privatization of the cabins.
– This is a complex issue where we have a plan that prohibits sectioning of the properties and a law prohibiting prohibition sectioning. It is very useful for us in Fredrikstad that some of the country’s most competent lawyers in the field have considered the matter, said councilman Ole Petter Finess.

Finess says that the report outlines several possible ways forward in the case that the municipality now must consider.
