The13-pageinternalpolicememoBThasgainedaccesstoisnotpreviouslydiscussed.ItwaswritteninlateMarch2014inpreparationforameetingabouttheobjectionstoSchaefer.
Themeetingwasareviewofthecase,soDeputyPoliceGunnarFløystadhadrequestedinadvance.
WiththemeetingwasprosecutingleaderSidselIsachsen.ThispaperreflectswhatwillbeabroadconsensusfrombothjuristIsachsenandinvestigatorswhohadworkedonthecase.

HeexplainsthathismothermighthavehiddenMonikamobile,thathasneverbeenfound,andsoapparentlybeensurprisedwhenthepoliceexplainedthatthephonewasnottofind.Similarly,shewasalsosurprisedthatthepolicetoldherthattheydismissedthecaseassuicide,despitethefactthatcounselhadalreadyinformedher.

Forthecorrespondingpolicedetective:”Well,ifitisthemotherwhohassimulatedburglary,theft,spicesandcaredthephonetohisdaughtertocoverevenmurder’snotthereanymoreunlikelythananythingelse.Unlessdaughterunderstands”finality”infailingsuchanexperiment,itisconceivablethatshemakesa”seewhatcouldhappenwhenyoudonotanswerthephone,Mom»-opplegg.Perhapsincombinationwithcrushingholeinthedoor.”

“Ifaburglarorchildkillershoulddothis,hewouldthenhaveputdowntheemptyspiceboxbasically,ontherackwherejewelryallegedlystolenfrom,andgothroughthespiceback?Iftherewasaburglarythatwentwrong,itwouldthenbethefirstburglarweknowthatusespicestocontaminatethecrimescene.”
Thespicewas,writespoliceman,oneofseveral”weirdthings”theyhadponderedformonths.”Onetheorythathasgainedacertainadherenceisthatmotherafterfindingherdaughterso,curseanddespairhavegonetothekitchen,grabbedholdofwhatshefoundandthrewbothspiceboxeswithgreatforce.”
RejectedDNAtraces
PoliceinvestigatorrolewereconsideredbytheBureau.Theyconcludedthattheydidnotfindanythingpunishableproven.Isachsenrelationshipwasdismissedevidence.
BThasbeenincontactwithpolicedetective.Inamessage,hewritesthatthenotewaswrittendownbyvariousfactorsthatshouldbediscussedinthemeeting,whereitcouldbeusedonalargescreenduringdiscussions.Itwasstillnotused.Thememorandumwasthereforepreparationandmaynotshowtheoutcomeofthemeeting.
Inthepolicecommissioner’sformalresponsetothePublicProsecutionsscrutinythisweek,regrettedactingPoliceChiefJohnReidarNilsenthatthosewhohadalreadyconcludedsuicidewasalsosettoconsiderSchaefersobjections.
AfterMonikacasewasresumed,arrestedpolicehermother’sex-boyfriend.PolicemainevidenceisDNAtracesfromseveralplacesonthebodytoeightyearold.
ControversialDNAtraces
WhenNotifierRobinSchaeferfirsttimeaskedthatthecasewasresumedonJanuary6lastyear,hementionedspecificallyDNAtracesonthebeltaroundMonikasthroat:
“belthasDNAfromMonika.InadditionasmallpartofanotherDNAprofile.Itcanbefromaperpetrator,”wroteSchaefer.
ThememofromMarch2014commentingpointso:
“CAN,butalsofromtheowner,oranyonewhohastouchedorbeenclosebeltsincelastitwascleaned.Itissosmallthatitisnotsuitableforcomparison.”
SixmonthslatermanagedDNAspecialistsattheNIPHtoisolateenoughtogiveapartialprofile.Immediatelyafterthe32-year-oldarrested.
